Florida Family Law Rule 12.285 Mandatory Disclosure Checklist

Fla. Fam. L. R. P. 12.285 mandates that parties to a family law case exchange comprehensive financial documentation within 45 days of initial petition service. This requirement is automatic and does not require formal discovery requests from the opposing party.

The 16 Mandatory Disclosure Categories

  1. Financial Affidavit: A fully executed Form 12.902(b) or 12.902(c) with all required schedules.
  2. Federal & State Tax Returns: All individual federal and state tax returns for the past 3 years, including all W-2s, 1099s, and attached schedules.
  3. IRS Verification / Extension: IRS Form 4506-C or proof of filed extension if returns have not been filed.
  4. Pay Stubs: Pay stubs or proof of all earned income for the past 3 months.
  5. Corporate Tax Returns: Federal and state returns for any partnership, corporation, LLC, or joint venture in which you have an ownership interest of 30% or greater for the past 3 years.
  6. Loan Applications: All loan applications and credit statements submitted to financial institutions within the past 24 months.
  7. Real Estate Deeds & Mortgages: Deeds, leases, promissory notes, and closing settlement statements for real property owned or leased within the past 3 years.
  8. Bank Statements: Statements for the past 12 months for all personal checking, savings, money market, and CD accounts.
  9. Brokerage & Investment Records: Statements for the past 12 months for stocks, bonds, mutual funds, cryptocurrency exchanges, and commodities accounts.
  10. Retirement Plans: The most recent account statements and summary plan descriptions for pension, profit sharing, 401(k), 403(b), IRA, and deferred compensation plans.
  11. Life Insurance Policies: All life insurance policies on your life or the life of your spouse, including declarations pages and cash surrender valuations.
  12. Health & Dental Insurance Cards: Health, dental, and vision insurance cards and documentation of monthly premium costs.
  13. Corporate Financial Statements: Balance sheets, income statements, and ledgers for closely held businesses.
  14. Pre-Marital & Post-Marital Agreements: Any written agreements entered into between the parties prior to or during the marriage.
  15. Court-Ordered Obligations: Judgments, child support orders, or domestic violence injunctions from previous matters.
  16. Credit Card Statements: Statements for the past 24 months for all credit card and revolving charge accounts.

Serving Certificate of Compliance (Form 12.932)

Do NOT file the sensitive underlying financial records (tax returns, bank records, credit cards) in the public court file. Instead, serve the documentation directly upon opposing counsel, and file only Form 12.932 (Certificate of Compliance with Mandatory Disclosure) with the Clerk of the Circuit Court.
